چکیده

پس از گذشت یک ‌دهه از زمان تصویب نخستین متن قانونی کشور درخصوص مقررات حاکم‌بر رویه‌های اتخاذ حمایت‌های اقتضایی تجاری‌، سال گذشته متن مزبور موردبازنگری قرار گرفت و متن قانونی جدیدی در این خصوص جای‌گزین متن پیشین شد و اینک یک سال است که متن قانونی جدید لازم‌الاجرا شده است. باوجوداین، بازنگری متن مزبور هرچند با بهبودهای متنی قابل‌توجهی ‌هم‌راه بوده است، ‌هم‌چنان به‌جهت کاستی‌های فرامتنی نتوانسته است سازوکار حمایت‌های اقتضایی تجاری را در حمایت از تولید ملی در ایران فعال سازد. این در حالی است که روند فزاینده و شتابانی از به‌کارگیری این اقدامات در جهان مشاهده می‌شود که کشورمان را نیز از دامنۀ شمول خود برکنار نداشته است. این مقاله، با نگرشی نقادانه بر کارکردهای حمایت‌های اقتضایی تجاری در جهان و ضرورت‌هایی که ایران با آن مواجه است، به ارزیابی سازوکار حمایت‌های اقتضایی تجاری در ایران می‌پردازد.

چکیده [English]

A decade after the adoption of the first legal text of the country regarding the rules governing the procedures for the application of Trade Contingency Protections (TCP), the text was revised last year and a new legal text replaces the previous text in this regard. However, after more than one year passed from the enforcement of new legislation, the revision of the text, albeit with significant text enhancements, has not yet been able to activate the mechanism of TCP in support of national production in Iran, due to shortcomings beyond the text although there is an increasing trend in the use of these measures in the world, which has not put our country aside from its scope. This paper with a critical view examines the functions of TCP in the world and the necessities that Iran is faced with.
